RATIFICATION OF REASSIGNMENT OF STUDENTS TO SCHOOLS

8. RATIFICATION OF REASSIGNMENT OF STUDENTS TO SCHOOLS
Description

Reassignment of students to schools within the county have been approved by the administration or recommended by the Student Reassignment Appeal Board, in accordance with policies of the School Board.  They are presented for formal ratification.

GENERAL ITEMS

9. APPROVAL OF THE CHANGE TO THE TEMPORARY/SUBSTITUTE/AFTER-BEFORE SCHOOL CHILDCARE SALARY SCHEDULE
Description
Only the staff development participant hourly amount of $12.00 per hour be changed to $15.00 per hour.  All other rates remain the same.

AGREEMENTS/CONTRACTS

10. CONTRACT BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND CHILDREN'S THERAPY WORKS
Description
The Individuals with Disabilities Education Act IDEA (2004) requires school districts to set aside a proportional of their Federal IDEA funds to provide services to students with disabilities enrolled in private schools by their parents, including McKay Scholarship students.  The services most requested by private schools are speech therapy, occupational therapy and physical therapy.  Since the district does not have direct hire staff available to provide these services, contracts with private vendors like Children's Therapy Works are being implemented to meet this requirement.

Recommendation

That the contract for speech therapy, occupational therapy and physical therapy services between the School Board of Sarasota County, Florida, and Children's Therapy Works in an amount not to exceed $70,000, be approved as presented.



11. CONTRACT BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND SUNCOAST THERAPY SERVICES
Description
The Individuals with Disabilities Education Act IDEA (2004) requires school districts to set aside a proportional of their Federal IDEA funds to provide services to students with disabilities enrolled in private schools by their parent including McKay Scholarship students.  The services most requested by private schools are speech therapy, occupational therapy, and physical therapy.  Since the district does not have direct hire staff available to provide these services, contracts with private vendors like Suncoast Therapy Services are being implemented to meet this requirement.

Recommendation
That the contract for speech therapy, occupational therapy and physical therapy services between the School Board of Sarasota County, Florida, and Suncoast Therapy Services in an amount not to exceed $35,000, be approved as presented.

12. ADDENDUM TO THE CURRENT 2007-08 POLICIES AND PROCEDURES FOR THE PROVISION OF SPECIALLY DESIGNED INSTRUCTION AND RELATED SERVICES FOR EXCEPTIONAL STUDENTS (SP&P), AS AMENDED, REMAIN IN EFFECT THROUGH 2008-09
Description
The second nine new and/or revised rules were approved by the SBE on June 17, 2008; final adoption of these rules is on hold pending a response to a request for information from the Joint Administrative Procedures Committee (JAPC) and a response to a current challenge filed on July 18, 2008.  Until such time as the rules are adopted, the current rules remain in effect.

Recommendation
That this addendum be approved as presented.

13. CONTRACT FOR SERVICES BY INDEPENDENT CONTRACTORS BETWEEN THE SARASOTA COUNTY SHERIFF'S DEPARTMENT AND SARASOTA COUNTY TECHNICAL INSTITUTE
Description

Provide security for Sarasota County Technical Institute's three (3) campuses during the 2008-09 school year, Monday through Thursday (after the regular school day is completed).



Recommendation
That the Contract for Services by Independent Contractor between the Sarasota County Sheriff's Department and SCTI be approved.

14. APPROVAL OF BLACKBOARD CONNECT (FORMERLY NTI SERVICE AGREEMENT)
Description

Approval of amendment to agreement with Notification Technologies Inc. (now Blackboard Connect) to extend services of the Connect Ed product, which is a telephone notification capability that allows the dissemination of District-wide and School-wide information to students' and employees' homes.  The existing agreement expires August 31, 2008.

The agreement is for the next 5 years and the amendment uses a bid share from Manatee County School Board.  The rate is $3.00 per student which is $.60 less than the previous agreement.  This is a $25,000 savings per year from previous years.  By renewing this agreement we will also save $6000 in set-up fees.



Recommendation
That the Board approves the Blackboard Connect Amendment No. 1 to continue current agreement.

15. AGREEMENT BETWEEN YMCA CHILDREN, YOUTH AND FAMILY SERVICES, INC. FOR YMCA CHARACTER HOUSE AND THE SCHOOL BOARD OF SARASOTA COUNTY
Description
This agreement defines the relationship and responsibilities between the School Board of Sarasota County and YMCA Character house for providing an appropriate program of education and training for students assigned to Character House.

Recommendation
That the School Board of Sarasota County approve the agreement as provided.

16. AGREEMENT BETWEEN !A+ TUTOR U AND THE SCHOOL BOARD OF SARASOTA COUNTY TO PROVIDE SUPPLEMENTAL EDUCATIONAL SERVICES
Description
!A+ Tutor U will provide small group tutoring services to eligible students attending Title I schools not meeting AYP.  Tutoring sessions will take place either on-site (schools) or off-site (public libraries) for no less than 1 hour per session.

Recommendation
That the School Board of Sarasota County approve the agreement with !A+ Tutor U to provide SES tutoring.

17. CONTRACT FOR SERVICES BETWEEN INDEPENDENT CONTRACTOR KIA GARNETT AND THE SCHOOL BOARD OF SARASOTA COUNTY
Description

Title I SES Coordinator/Non-Public District Facilitator: to maintain School Board of Sarasota County District NCLB Compliance (public law 107-110) for school year 08-09.

That the School Board of Sarasota County approve the contract as presented.

18. CONTRACT FOR SERVICES BETWEEN INDEPENDENT CONTRACTOR CAROLYN MAJOR-HARPER AND THE SCHOOL BOARD OF SARASOTA COUNTY
Description

Title I Parent Involvement Facilitator: to maintain School Board of Sarasota County District NCLB Compliance (public law 107-110) for school year 08-09.   



Recommendation
That the School Board of Sarasota County approve the contract as presented.

19. APPROVAL OF AGREEMENT FOR SERVICES BY INDEPENDENT CONTRACTOR RILEY CHASE APARTMENTS, IN NORTH PORT, FOR THE 21ST CENTURY COMMUNITY LEARNING CENTER PROGRAM IN SOUTH COUNTY
Description
This agreement details the relationship and responsibilities shared by the School Board of Sarasota County and Riley Chase apartments to provide enrichment, tutorial, and extra-curricular activities as outlined in the 21st CCLC grant.

Recommendation
That the School Board of Sarasota County approve the agreement with Riley Chase apartments for 21st CCLC 08-09, as presented.

20. AGREEMENT BETWEEN EDUCATIONAL TUTORIAL SERVICES AND THE SCHOOL BOARD OF SARASOTA COUNTY TO PROVIDE SUPPLEMENTAL EDUCATIONAL SERVICES
Description
Educational Tutorial services will provide individual or small group tutoring services to eligible students attending Title I schools not meeting AYP. Tutoring sessions will take place either off-site (libraries) or in-home, for no less than 1 hour per session.

That the School Board of Sarasota County approve the agreement with Macedonia Human Services Cultural Training Center, Inc. to provide SES tutoring.

Description

That the School Board of Sarasota County approve the agreement with Accuracy Temporary Services D/B/A ATS Project Success to provide SES tutoring.

Description

Huntington Learning Centers, Inc. will provide individual or small group tutoring services to eligible students attending Title I schools not meeting AYP. Tutoring sessions will take place off-site (Huntington Learning Centers) for no less than 1 hour per session.

That the School Board of Sarasota County approve the agreement with Huntington Learning Centers, Inc. to provide SES tutoring.

EXPULSIONS

31. APPROVAL OF EXPULSION CASE NO. 08-134
Description
The student listed in Expulsion Case No. 08-134, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On November 29, 2007, the student listed in Expulsion Case No. 08-134, violated School Board Policy 5.34(1)(d), Grand Theft.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until January 1, 2009.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b) Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 08-134, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until January 1 of the 2008-2009 academic year.

32. APPROVAL OF EXPULSION CASE NO. 08-140
Description

The student listed in Expulsion Case No. 08-140, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On December 6, 2007, the student listed in Expulsion Case No. 08-140, violated School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until December 21, 2008.



Recommendation
That in accordance with provisions of Section 1006.07(1)(a)(b) Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 08-140, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until December 21 of the 2008-2009 academic year.

Description

The student listed in Expulsion Case No. 08-073, is in violation of an accepted Deferred Expulsion Agreement for regular school placement.  On November 6, 2007, the student listed in Expulsion Case No. 08-073, violated School Board Policy 5.322, Prohibition Against Use, Sale or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until October 31, 2008.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b) Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 08-073, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until October 31 of the 2008-2009 academic year.

34. APPROVAL OF EXPULSION CASE NO. 08-408
Description
School Board Policy 5.34(4), permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student is being placed in an alternative school.

Recommendation
That Expulsion Case No. 08-408, be held in abeyance per School Board Policy 5.34.

35. APPROVAL OF EXPULSION CASE NO. 08-110
Description
The student listed in Expulsion Case No. 08-110, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On November 15, 2007, the student listed in Expulsion Case No. 08-110, violated School Board Policy 5.34(i)(e), Disruption of School Campus.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until December 5, 2008.

Recommendation
That in accordance with provisions of Sections 1006.07 (i)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 08-110, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until December 5 of the 2008-2009 academic year.

36. APPROVAL OF EXPULSION CASE NO. 08-413
Description

On May 27, 2008, the student listed in Expulsion Case No. 08-413, violated School Board Policy 5.32, Zero Tolerance and School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until May 30, 2009.



Recommendation
That in accordance with provisions of Sections 1006.07(i)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 08-413, to expel the student referenced therein from the Sarasota County Schools be approved effective immediately for the entire 2008-2009 academic year.

37. APPROVAL OF EXPULSION CASE NO. 08-246
Description

On February 5, 2008, the student listed in Expulsion Case No. 08-246, violated School Board Policy 5.34(i)(d), Assault on Another Student.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until February 5, 2008.



Recommendation
That in accordance with provisions of Sections 1006.07(i)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 08-246, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until February 5 of the 2008-2009 academic year.

38. APPROVAL OF EXPULSION CASE NO. 08-300
Description

MATERIALS MANAGEMENT

39. APPROVAL OF CLASSIFICATION OF INOPERATIVE EQUIPMENT AND FURNITURE AS PROPERTY TO BE DELETED
Description

The custodians of the property (cost center heads) have certified it to be traded in on new equipment, unaccounted for, not repairable or otherwise inoperable.  Property still on hand after reallocation will be salvaged for any useful parts and then sold at auction.



Recommendation

That the classification of inoperative equipment and furniture, as property to be deleted, be approved.

40. ACCEPTANCE OF SUBSTANTIAL COMPLETION FOR THE GARDEN ELEMENTARY SCHOOL - GENERATOR FUEL TANK UPGRADE PROJECT
Description
The architect has prepared the Certificate of SubstantialCompletion and final punch list.  The project is substantially complete in accordance with the contract documents.

Recommendation

That the work performed by McIntyre Elwell & Strammer General Contractors, Inc. for the Garden Elementary School - Generator Fuel Tank Upgrade project be accepted as substantially complete as of 6/4/2008.

CONSTRUCTION

43. APPROVAL OF NON-EXCLUSIVE UTILITY EASEMENT AT RIVERVIEW HIGH SCHOOL BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND FLORIDA POWER & LIGHT COMPANY
Description
This easement will assign an easement for the construction, operation and maintenance of overhead and underground electric utility facilities (including wires, poles, guys, cables, conduits and appurtenant equipment) to be installed from time to time; with the right to reconstruct, improve, add to, enlarge, change the voltage, as well as the size of and remove such facilities or any of them within an easement 10 feet in width.  This easement has been approved by the School Board attorney.

Recommendation
That the Non-Exclusive Easement at Riverview High School between he School Board of Sarasota County, Florida, and Florida Power & Light Company be approved as presented.

44. RATIFICATION OF AMENDMENT #4 WITH SCHENKEL SHULTZ ARCHITECTURE FOR THE NORTH COUNTY TECHNICAL CENTER PROJECT
Description

The scope of work for the amendment shall include the re-design and re-detail of the recessed slab areas as required to change from 2-1/2" to 4" recess for Phase 1A/2.  This additional recess will allow for clearance for under-floor data and electrical cabling.

The cost of this amendment shall not exceed $5,246.00.  Funds for this amendment are available through the project budget account.

That Amendment #4 to the agreement dated 10/4/2005 with Schenkel Shultz Architecture for the North County Technical Center project be ratified as presented.

45. RATIFICATION OF AMENDMENT #5 WITH SCHENKEL SHULTZ ARCHITECTURE FOR THE SOUTH COUNTY TECHNICAL CENTER - SOUTH COUNTY TECHNICAL HIGH SCHOOL "CCC" PROJECT
Description

The scope of work for the amendment shall include the following changes to Contingent Additional Services sections:

3.2.1.A - On-site surface water management and drainage design revisions based on criteria required by 4th Quarter Properties Pattern Book, specifically the 100 year storm event as the basis for design for the project.  This also includes the requirement by SWFWMD to use Sarasota County's Flood Plain Map as the basis of design as Flood Plain compensation for the proposed site.  Items identified here are required to receive the SWFWMD ERP for this project.  This is an increase of $14,400.00.

3.2.2.A - Off-site surface water management and drainage design revisions based on criteria required by 4th Quarter Properties Pattern Book, specifically the 100 year storm event as the basis for design for the project.  This also includes the requirement by SWFWMD to use Sarasota County's Flood Plain Map as the basis of design as Flood Plain compensation for the proposed site.  Items identified here are required to receive the SWFWMD ERP for this project.  This is an increase of $18,000.00.  

The cost of this amendment shall not exceed $32,400.00.  Funds for this amendment are available thorugh the project budget account.

46. APPROVAL OF UPDATE #1 TO THE 2008/2009 ANNUAL CERTIFICATION OF PROFESSIONALS FOR CONSTRUCTION RELATED SERVICES
Description
The recommended professionals have submitted annual request for certification by the School Board to provide professional construction related services for Sarasota County School Board projects.  These submissions are in accordance with School Board Policy #7.71.  The initial list for the 2008/2009 year was Board approved on 7/22/2008 (Item #88).  The newly added firms are identified, on the enclosure, at the end of the initial listing and are in bold print.  Upon Board approval, the pertinent data from these submissions will be incorporated to the existing list.

Recommendation
That Update #1 to the 2008-2009 Annual Certification of Professionals for Construction Related Services be approved as presented.

47. APPROVAL AND/OR RATIFICATION OF CONSTRUCTION SERVICES CHANGE ORDER(S)

The Change Order(s) are summarized on the enclosure for ease of review.  These change orders collectively total an increase of $1,131,849.15 in contract amounts.

FINANCE

48. RENEWAL OF GROUP VISION CARE INSURANCE FOR CALENDAR YEARS 2009 AND 2010
Description

Vision Care Plan (a division of Humana/CompBenefits, Inc.) has agreed to renew the district collectively bargained group vision program and guarantee the expiring rate of $4.19 per employee per month for an additional two years.  The dependent cost paid by employees will be unchanged and guaranteed for the same two year period.  The existing rate structure has been unchanged since 1998.  There will be no change in benefits or coverage.



Recommendation
That the group Vision Care Plan renewal, effective January 1, 2009 through December 31, 2010, be approved as presented.

49. APPROVAL OF FINAL BUDGET AMENDMENTS FOR THE 2007-2008 FISCAL YEAR
Description
General Fund budget amendment number four, Debt Service budget amendment number one, Capital Outlay budget amendment number five, Special Revenue budget amendment number one, and Self Insurance budget amendment number one are required as a result of the completion of the Annual Financial Report to insure that no appropriations are above the final amended budget.

Recommendation
That the final budget amendments for the 2007-2008 fiscal year be approved as presented.

50. APPROVAL OF ANNUAL FINANCIAL REPORT FOR FISCAL YEAR 2007-2008
Description

Chapter 6A-1.0071 (2) of the State Board of Education Administrative Rules requires that the Annual Financial Report be submitted to the Florida Commissioner of Education no later than the 11th of September each year.  Due to the complexity of the report, it will not be available for distribution until September 1.

54. ADOPTION OF SCHOOL BOARD POLICY 7.78, ON ADEQUACY OF EDUCATIONAL FACILITIES AND GROWTH MANAGEMENT
Description
Chapters 163 and 1013, F.S., require School Boards to submit various facility documents to the Florida Department of Education and to implement School Concurrency.  This policy will link the district's adoption of Educational Specifications, submission of the Five-Year Work Plan, and the current Interlocal Agreement on School Facility Planning with new language establishing a growth management system that implements School Concurrency.  In addition to the policy, staff will enact procedures delineating the district's responsibilities with local governments and developers of residential projects. 

Recommendation
That the School Board of Sarasota County adopt Policy 7.78, on Adequacy of Educational Facilities and Growth Management.

55. ADOPTION OF AMENDED INTERLOCAL AGREEMENT FOR PUBLIC SCHOOL FACILITY PLANNING FOR THE COUNTY OF SARASOTA, FLORIDA
Description
Chapters 163 and 1013, F.S., require intergovernmental coordination with regard to public school siting and to establish this by interlocal or other formal agreement executed by all entities, along with the implementation of School Concurrency. This amended interlocal agreement includes changes agreed upon by all municipalities at the January 2008 Convocation. It also contains items for clarification agreed upon by the Facilities Strategy Team members.

Recommendation
That the School Board of Sarasota County adopt Amended Interlocal Agreement for Public School Facility Planning for the County of Sarasota, Florida.
